NFTs and Copyright

Hugh Stephens examines the copyright issues related to NFTs – “non-fungible tokens”- the digital phenomenon that has taken off in recent weeks as wealthy investors purchase, often at art auctions, digital representations of “something”.

Often purchased using (large amounts of) cryptocurrency, they cannot be duplicated as each has a unique digital signature. However, one thing is certain. It is the creator of the artwork or music in an NFT who owns the copyright to the underlying work, not the purchaser unless the sale includes the sale of certain rights.
